South Carolina Real Estate & Litigation Attorney, Independent Counsel (Remote)

The Role 

Blue Peak is seeking an entrepreneurial South Carolina attorney to serve as Independent Counsel through a law practice the attorney independently owns or manages. It is a long-term, high-trust legal-services relationship between Blue Peak and an independent law practice.

The attorney will serve as counsel to Blue Peak for the agreed scope of South Carolina work. You will work directly with the Founder & CEO, and alongside the business operations manager, transaction coordinator, acquisitions representatives, and field operations representatives who manage files day to day. You will handle the legal work behind active acquisitions: quiet title actions, partition actions, evictions, deed preparation and recording, title and ownership analysis, lien and payoff issues, and disputes arising from estate and heir-property transactions.

Blue Peak will set business priorities, share the facts needed for representation, and make business decisions. You will retain independent professional judgment over legal advice, legal strategy, staffing, representation decisions, and compliance with your ethical and professional obligations. The final agreement will define the represented Blue Peak entity or entities, scope, conflicts procedures, fees, expenses, term, and termination rights.

You do not need to have practiced real-estate law before. Attorneys with strong experience in employment law, personal injury, civil litigation, creditor-side work, commercial disputes, or another high-volume, deadline-driven practice can be strong candidates. What matters is sound judgment, strong writing, comfort with litigation-related work, the ability to learn quickly, and a genuine interest in complex real-estate matters.

Your core responsibilities will include:

• Provide legal advice on active Blue Peak matters. Advise the identified Blue Peak client entity or entities on acquisitions, distressed and off-market transactions, deeds, notices, title or ownership issues, transaction documents, foreclosure-related matters, and other issues within the agreed scope.
• Handle or coordinate dispute and court-facing work. Assess legal risk; prepare or manage filings, correspondence, hearings, and time-sensitive matters; and travel across South Carolina when court, closing, property, or in-person requirements call for counsel’s presence.
• Support transaction execution. Coordinate with closing attorneys, title parties, courts, notaries, counterparties, and appropriate specialists so legal issues, missing documents, and decision points are identified early and handled appropriately.
• Build practical legal processes. Recommend and, where agreed, develop matter-intake standards, templates, checklists, document controls, escalation rules, and legal-status reporting that help Blue Peak manage recurring work more consistently. Blue Peak retains responsibility for its own business operations; counsel retains responsibility for legal work and legal judgment.
• Identify the need for specialist support. Determine when a matter falls outside the agreed scope or requires specialist counsel, title professionals, or other expertise. Counsel will recommend escalation and coordinate any approved specialist involvement consistent with the client’s instructions and professional duties.
• Maintain appropriate legal-service boundaries. Protect client confidentiality, preserve privilege where applicable, manage conflicts, and keep legal advice separate from ordinary business coordination and operational tracking.
• Represent Blue Peak only. Counsel represents the identified Blue Peak entity and will not advise, represent, or prepare documents on behalf of heirs, sellers, or other counterparties. Blue Peak's process provides for counterparties to obtain independent counsel or to execute appropriate disclosures.

This relationship provides meaningful access and responsibility, but it has clear limits. Blue Peak will not own, control, or manage the attorney’s law practice; direct the attorney’s legal judgment; or share in legal fees earned by the attorney or the attorney’s firm. The attorney will not receive Blue Peak equity, options, shareholder rights, voting rights, or corporate-control rights by virtue of this relationship or title.

About You 

You are a South Carolina attorney in good standing with approximately 3-5 years of progressively responsible legal experience. You have handled demanding files, managed deadlines, written clearly, and exercised sound judgment when the facts were incomplete and the outcome mattered.

You may have built your background in employment law, personal injury, civil litigation, creditor-side work, commercial disputes, foreclosure, title, real estate, or a comparable practice. Real-estate experience is welcome but not required. If you come from a transferable practice area, you must be prepared to develop relevant subject-matter competence deliberately and engage experienced specialist counsel where a matter requires expertise beyond your own.

You are litigation-capable. You can manage filings, hearings, disputes, court and opposing-party communications, and the practical work needed to keep a matter moving. You can distinguish a true legal risk from a noisy issue, explain that distinction in plain English, and give a client clear, responsible options.

You have personally owned a difficult matter, a practice improvement, or a process problem from start to finish. You can explain the original issue, your role, how you created a workable path forward, and the result. You are organized enough to control details and entrepreneurial enough to improve the process rather than accept recurring confusion.

You are comfortable using technology, documentation, and automation to improve legal work. You understand that legal files, confidential client information, and AI-enabled tools require thoughtful access, retention, vendor, confidentiality, privilege, and human-review controls.

You are good with people and comfortable with accountability. You can work directly with a founder and operating team, communicate legal advice without jargon, manage tension without unnecessary friction, and stay calm when several moving parts need attention at once.

If you have worked on the creditor side in foreclosure, collections, or bank-side litigation, you will recognize most of this work from the other direction. That perspective is valuable here.

A conventional firm pedigree, advanced degree, or prior real-estate-law title is welcome but not required. Demonstrated judgment, litigation ability, writing, learning agility, professional maturity, and high agency matter more.

This relationship is not for an attorney who wants a conventional in-house employee role, expects corporate equity because of the strategic nature of the work, is unwilling to travel within South Carolina when matters require it, or prefers a narrow routine-closing or document-production practice. It is also not suited to someone who cannot commit prioritized, responsive capacity to Blue Peak's matters for the agreed term and scope, subject always to conflicts, professional responsibilities, and the final engagement agreement. 

What This Opportunity Provides 

You keep your own practice and work directly with the Founder & CEO. You will also work alongside the operating team that keeps files moving: a business operations manager, transaction coordinator, acquisitions representatives, and field operations representatives. There is no legal department to route through and no committee to wait on. Decisions get made the same day.

The work is one client, one area of law, and a defined set of matter types that repeat. You will build a process around it rather than starting from scratch on every file. That means no billable hour targets, no scattered caseload across unrelated practice areas, and a caseload predictable enough to plan around.

Blue Peak is growing its South Carolina acquisitions and taking on more complex files. The work is substantive: contested estates, heir-property title, partition and quiet title actions, and foreclosure-related disputes.

Compensation & Engagement Terms

This is an independent legal-services engagement, not an employment relationship. Blue Peak anticipates a total annual value of $100,000-$125,000 for the agreed base scope of work. Work outside that scope will be compensated separately under an approved fee schedule or written matter authorization. This includes litigation, hearings, closings, specialist coordination, urgent matters, and other defined categories.

The compensation structure will be documented in writing before engagement. It will not tie compensation to legal recoveries, settlements, or the outcome of legal advice or representation.

The final engagement agreement will specify payment cadence, travel reimbursement, approved expenses, records handling, and any administrative or transaction-coordination support. The attorney's firm will maintain its own professional liability coverage and remain responsible for its own professional operations, staffing, legal systems, and professional obligations.

Blue Peak intends this to be a long-term working relationship for the agreed scope and term. The agreement will address the defined engagement period, renewal, termination notice, permitted exceptions, conflicts, professional independence, client identity, and procedures for matters that require separate or specialist counsel.
