Requirements:

Employment in this position is contingent upon a satisfactory criminal history check (fingerprint-based) in accordance with Chapter 435, Florida Statutes.

Incumbent will have financial disclosure reporting responsibility in accordance with Section 112.3145, Florida Statutes.

Office hours will be set between 8:00 am and 5:00 pm Eastern Standard Time, Monday through Friday.

20-30 flexible hours on average. Possibly more during trials and hearings.

The supervisor will work with the employee to select a schedule within office hours that works best for the employee and the position. This position will occasionally require work time outside of regular scheduled hours, including evenings and weekends. 

This position requires the ability to travel up to 25%.

Education, Experience, and Certification:

• Active member of The Florida Bar, in good standing;
• At least seven (7) years of relevant work experience.

Overview:

The Legal Office provides a wide range of legal services to the Florida Fish and Wildlife Conservation Commission and staff. The Commission’s mission and topic areas are broad and include hunting and fishing rulemaking and enforcement, endangered and threatened species protection, public land management, captive wildlife regulation, recreational and commercial permitting, procurement, grants, human resources, and litigation related to any of these areas.

The employee’s responsibilities will directly support and effect the State of Florida. The Florida Fish and Wildlife Conservation Commission’s mission is to manage fish and wildlife resources for their long-term well-being and the benefit of people. The head of the Florida Fish and Wildlife Conservation Commission is the Commission, comprised of seven commissioners, appointed by the governor and subject to confirmation by the Senate. The commission has the authority to exercise the executive and regulatory powers delegated to FWC through Article IV, Section 9 of the Florida Constitution as well as additional powers and duties as provided by the Florida Legislature.

Duties and Responsibilities:

The Commission’s Office of General Counsel is hiring an experienced employment law attorney to advise the Commission on labor and employment matters to include agency discipline, collective bargaining, claims of discrimination, grievance-arbitration, and other state and federal employment law issues.  Experience in public sector labor and employment, litigating before administrative forums, and knowledge of the Administrative Procedures Act and chapter 112, Florida Statutes is preferred. The employee in this position will perform the following legal activities for the Commission:

• Serve as the legal advisor to senior management and work closely with the Office of Human Resources and the Division of Law Enforcement advising on employment-related matters to include employee disciplinary actions, collective bargaining, grievance arbitrations, EEO/FCHR, ADA accommodations, the Officer’s Bill of Rights, Workers’ Compensation, FMLA eligibility, Veterans’ Preference, and other issues;
• Serve as the Commission’s legal liaison with outside counsel responsible for defending the Commission in employment-related cases;
• Assist the Agency’s Chief Ethics Officer in addressing potential conflicts and providing legal guidance. 
• Develop litigation strategy and attend depositions, mediations, arbitrations, hearings, and trials on the Commission’s behalf;
• Represent the Commission before the Public Employee Relations Commission (PERC), the Division of Administrative Hearings (DOAH), the Florida Commission on Human Relations (FCHR), the Equal Employment Opportunity (EEO) and other forums;
• Handle wage garnishments
• Draft Position Statements
• Develop and provide training on a vast array of employment-related laws and policies;
• Coordinate activities undertaken on behalf of the agency by outside counsel including representation provided from the Office of the Attorney General, and representation provided under insurance coverage through the Division of Risk Management;
• Provide briefings to Executive Leadership, Law Enforcement Division Commanders, and Division Management on issues of importance.
• Review and advise the Commission on possible impacts of proposed legislative changes;
• Other duties as assigned by the supervisor and general counsel.

Knowledge, Skills, and Abilities:

• Administrative law knowledge in a variety of forums to include Division of Administrative Hearings (DOAH) and the District Courts of Appeal
• Ability to obtain and interpret legal research
• Ability to communicate effectively both internally and with stakeholders and their representatives
• Strong writing and legal drafting skills, able to draft orders, pleadings, documents, memos, etc. with limited errors.
• Ability to comfortably use standard office software including Microsoft Word with track changes, Adobe Pro including electronic signature, Microsoft Outlook, and electronic case management systems
• Time management and organizational skills
• Knowledge of Florida laws and legal procedure
• Environmental or Wildlife law knowledge preferred
• Florida state government experience preferred
